Both G.F.W. Hegel and Carl Schmitt took seriously the problem of political sovereignty entailed by liberal political theories. In Dictatorship (1919) and Political Theology (1922), Schmitt rejects liberal political theories that argue for the immediate unity of democracy and legality i.e., popular sovereignty, because he thinks they cannot secure political sovereignty. In the Philosophy of Right, Hegel denounces popular sovereignty for similar reasons. Yet given Schmitt’s negative assessment of Hegel their positions are seldom related to one another. I argue in (...) this paper that Schmitt’s analysis of liberal political theories is similar to Hegel’s analysis of Rousseau’s liberal ideas. I contend, however, that Schmitt’s solution, which collapses the distinction between the executive and the legislative power in favor of the former, fails to secure political sovereignty. Contrary to Schmitt, Hegel conceives of the liberal predicament as a basic determination of any political state that rests on the division of the legislative and executive power. Hegel argues that the constitutional monarchy is a genuine instantiation of political sovereignty that can maintain not only the division of these powers, but also their unity. In this regard, I argue that Hegel’s conception of the division of powers provides a more convincing theory of the problem afflicting modern states than Schmitt’s and at least deserves to be taken more seriously by critics of Schmitt’s solution such as Hannah Arendt, Leo Strauss, Jurgen Habermas, Andreas Kalyvas and Chantal Mouffe. Monetary intelligence theory asserts that individuals apply their money attitude to frame critical concerns in the context and strategically select certain options to achieve financial goals and ultimate happiness. This study explores the dark side of monetary Intelligence and behavioral economics—dishonesty. Dishonesty, a risky prospect, involves cost–benefit analysis of self-interest. We frame good or bad barrels in the environmental context as a proxy of high or low probability of getting caught for dishonesty, respectively. We theorize: The magnitude and intensity of (...) the relationship between love of money and dishonest prospect may reveal how individuals frame dishonesty in the context of two levels of subjective norm—perceived corporate ethical values at the micro-level and Corruption Perceptions Index at the macro-level, collected from multiple sources. Based on 6382 managers in 31 geopolitical entities across six continents, our cross-level three-way interaction effect illustrates: As expected, managers in good barrels, mixed barrels, and bad barrels display low, medium, and high magnitude of dishonesty, respectively. With high CEV, the intensity is the same across cultures. With low CEV, the intensity of dishonesty is the highest in high CPI entities —the Enron Effect, but the lowest in low CPI entities. CPI has a strong impact on the magnitude of dishonesty, whereas CEV has a strong impact on the intensity of dishonesty. We demonstrate dishonesty in light of monetary values and two frames of social norm, revealing critical implications to the field of behavioral economics and business ethics. (shrink)

Corruption involves greed, money, and risky decision-making. We explore the love of money, pay satisfaction, probability of risk, and dishonesty across cultures. Avaricious monetary aspiration breeds unethicality. Prospect theory frames decisions in the gains-losses domain and high-low probability. Pay dissatisfaction (in the losses domain) incites dishonesty in the name of justice at the individual level. The Corruption Perceptions Index, CPI, signals a high-low probability of getting caught for dishonesty at the country level. We theorize that decision-makers adopt avaricious love-of-money aspiration (...) as a lens and frame dishonesty in the gains-losses domain (pay satisfaction-dissatisfaction, Level 1) and high-low probability (CPI, Level 2) to maximize expected utility and ultimate serenity. We challenge the myth: Pay satisfaction mitigates dishonesty across nations consistently. Based on 6500 managers in 32 countries, our cross-level three-dimensional visualization offers the following discoveries. Under high aspiration conditions, pay dissatisfaction excites the highest- (third-highest) avaricious justice-seeking dishonesty in high (medium) CPI nations, supporting the certainty effect. However, pay satisfaction provokes the second-highest avaricious opportunity-seizing dishonesty in low CPI entities, sustaining the possibility effect—maximizing expected utility. Under low aspiration conditions, high pay satisfaction consistently leads to low dishonesty, demonstrating risk aversion—achieving ultimate serenity. We expand prospect theory from a micro and individual-level theory to a cross-level theory of monetary wisdom across 32 nations. We enhance the S-shaped Curve to three 3-D corruption surfaces across three levels of the global economic pyramid, providing novel insights into behavioral economics, business ethics, the environment, and responsibility. The theoretical biology movement originating in Britain in the early 1930’s and the biosemiotics movement which took off in Europe in the 1980’s have much in common. They are both committed to replacing the neo-Darwinian synthesis, and they have both invoked theories of signs to this end. Yet, while there has been some mutual appreciation and influence, particularly in the cases of Howard Pattee, René Thom, Kalevi Kull, Anton Markoš and Stuart Kauffman, for the most part, these movements have developed (...) independently of each other. Focussing on morphogenesis understood as vegetative semiosis, in this paper I will argue that the ideas of these movements are commensurate. Furthermore, synthesising them would enable us to see life processes as proto-narratives. Doing so will involve synthesising biohermeneutics, Peircian biosemiotics with Waddington’s theoretical biology and Piagetian genetic structuralism, and this, I claim, would strengthen the challenge of these traditions to mainstream biology. At the same time, this should contribute to overcoming the opposition between the sciences and the humanities, developing a broader tradition of Schellingian thought which involves developing the humanities and then demanding of the physical and biological sciences that they are consistent with and can make intelligible the emergence of humans as conceived by the humanities. In this new book, Marko Zlomislić argues that Slavoj Žižek's work does not contain any sort of radical emancipatory project, especially as it passes through the ideology of communism and Lacanian psychoanalysis. The evidence for the failure of communism is vast and includes the more than six hundred mass graves recently located in Žižek's homeland of Slovenia. Zlomislić demonstrates that the way out of the capitalist dilemma is not a repetition of communism but a return to the late medieval notion (...) of haecceity or "individual thisness" that was rejected by modernity. Haecceity, or the indescribable and indefinite here and now of the person, shows that the late medieval Franciscans were already "postmodernists." It is no wonder that the totalitarianism of the modernist Hegel is embraced by thinkers such as Žižek, Badiou, Hardt, Negri, and Laclau and was already rejected by Leibnitz, Kierkegaard, Nietzsche, Levinas, Deleuze, and Derrida. This important book shows that Žižek's work must be rejected because it does not uphold the dignity, worth, and uniqueness of the person. (shrink)

Abstract.Evolutionary psychology and behavioural genomics are both approaches to explain human behaviour from a genetic point of view. Nonetheless, thus far the development of these disciplines is anything but interdependent. This paper examines the question whether evolutionary psychology can contribute to behavioural genomics. Firstly, a possible inconsistency between the two approaches is reviewed, viz. that evolutionary psychology focuses on the universal human nature and disregards the genetic variation studied by behavioural genomics. Secondly, we will discuss the structure of biological explanations. (...) Some philosophers rightly acknowledge that explanations do not involve laws which are exceptionless and universal. Instead, generalisations that are invariant suffice for successful explanation as long as two other stipulations are recognised: the domain within which the generalisation has no exceptions as well as the distribution of the mechanism described by the generalisation should both be specified. It is argued that evolutionary psychology can contribute to behavioural genomic explanations by accounting for these two specifications. (shrink)

In this study, we examine the influence of senior leadership on firms’ corporate social responsibility. We integrate upper echelons research that has investigated either the influence of the CEO or the top management team on CSR. We contend that functional experience complementarity between CEOs and TMTs in formulating and implementing CSR strategy may underlie differentiated strategies in CSR. We find that when CEOs who have predominant experience in output functions are complemented by TMTs with a lower proportion of members who (...) have experience in output functions, there is a pronounced effect on the community, product, and diversity dimensions of CSR. In turn, when output-oriented CEOs are complemented by output-oriented TMTs, we observe an effect on the employee relations dimension of CSR. Interestingly, we find no influence of CEO-TMT complementarity on the environment dimension of CSR. In general, our empirical results support the relevance of the interaction between CEOs and their TMTs in defining their firms’ CSR profile. (shrink)

Aristotle was the founder not only of logic but also of modal logic. In the Prior Analytics he developed a complex system of modal syllogistic which, while influential, has been disputed since antiquity--and is today widely regarded as incoherent. Combining analytic rigor with keen sensitivity to historical context, Marko Malink makes clear that the modal syllogistic forms a consistent, integrated system of logic, one that is closely related to other areas of Aristotle's philosophy. Aristotle's modal syllogistic differs significantly from modern (...) modal logic. Malink considers the key to understanding the Aristotelian version to be the notion of predication discussed in the Topics--specifically, its theory of predicables and the ten categories. The predicables introduce a distinction between essential and nonessential predication. In contrast, the categories distinguish between substantial and nonsubstantial predication. Malink builds on these insights in developing a semantics for Aristotle's modal propositions, one that verifies the ancient philosopher's claims of the validity and invalidity of modal inferences. While it acknowledges some limitations of this reconstruction, Aristotle's Modal Syllogistic brims with bold ideas, richly supported by close readings of the Greek texts. (shrink)

The philosophical literature on reasoning is dominated by the assumption that reasoning is essentially a matter of following rules. This paper challenges this view, by arguing that it misrepresents the nature of reasoning as a personal level activity. Reasoning must reflect the reasoner’s take on her evidence. The rule-following model seems ill-suited to accommodate this fact. Accordingly, this paper suggests replacing the rule-following model with a different, semantic approach to reasoning.

The issue whether psychopathic offenders are practically rational has attracted philosophical attention. The problem is relevant in theoretical discussions on moral psychology and in those concerning the appropriate social response to the crimes of these individuals. We argue that classical and current experiments concerning the instrumental learning in psychopaths cannot directly support the conclusion that they have impaired instrumental rationality, construed as the ability for transferring the motivation by means-ends reasoning. In fact, we defend the different claim that these experiments (...) appear to show that psychopaths in certain circumstances are not aware of the relevant means for their ends. Moreover, we suggest how further empirical research could help to settle the issue. (shrink)

According to current orthodoxy in the philosophy of action, intentional actions consist in intrinsically mindless bodily movements that stand in causal relations to appropriate mental states. This paper challenges this approach to intentional action, by arguing that there are not enough appropriate mental states around to ‘animate’ all of the bodily movements we intuitively count as intentional actions. In the alternative picture I suggest, the bodily movements that constitute our intentional actions are themselves to be thought of as cognitive events, (...) embodying our grasp of ways of acting. This paper examines the social theory of Lester Frank Ward, one of the most significant representatives of early American social theory, with particular attention to his conception of the state, which can be described as Hegelian. The first part of the paper gives a brief overview of early American social theory: its basic features, the issues that were the focus of attention during this period in the development of sociology in the US, and its most significant representatives. The basic features (...) of Ward’s social theory are then presented and examined in more detail. It is pointed out that it is: conceptual and essentially based on the natural sciences; based on the distinction between pure and applied sociology; systematic; supportive of progressive and pro-social reforms. It was directed against the individualist tradition. His theory was based on the belief that the human mind can direct social progress and that the order based on social inequalities, which is a product of the laissez-faire doctrine, cannot guarantee freedom and prosperity. The fundamental institution capable of doing so is the state. Therefore, the central part of this paper is devoted to his conception of the state and makes a comparison with Hegel’s theory of the ethical state contained in Hegel’s philosophy of objective spirit – philosophy of law and philosophy of history. It concludes by pointing out that Ward’s theory indicated the general direction of development of social circumstances towards the era of collectivism, and was also atypical of American social theory in some of its features. This volume presents a Type Theory of Law (TTL), claiming that this is a unique theory of law that stems from the philosophical understanding of Jung's psychological types applied to the phenomenon of law. Furthermore, the TTL claims to be a universal, general and descriptive account of law. To prove that, the book first presents the fundamentals of Jungian psychological types, as they had been invented by Jung and consequently developed further by his followers. The next part of the book (...) describes how the typological structure of an individual determines their understanding of law. It then addresses the way in which inclusive legal theory can be understood based on this typology. Finally, the book describes the TTL in general and descriptive terms and puts it into context. All in all, the book shows how the integral or inclusive approach to understanding the nature of law is not only in tune with our time, but also relevant for presenting a more persuasive picture of law than the older exclusivist or dualist approaches of strict natural law and rigid legal positivism did. In this article I discuss and evaluate the selectivity problem as a problem put forward by Bermudez (1997, 2000) against anti-intentionalist accounts of self-deception. I argue that the selectivity problem can be raised even against intentionalist accounts, which reveals the too demanding constraint that the problem puts on the adequacy of a psychological explanation of action. Finally I try to accommodate the intuitions that support the cogency of the selectivity problem using the resources from the framework provided by an anti-intentionalist (...) account of self-deception. Psychopathy, executive functions, and neuropsychological data: a response to Sifferd and Hirstein.

We prove, by a probabilistic argument, that a class of ω-categorical structures, on which algebraic closure defines a pregeometry, has the finite submodel property. This class includes any expansion of a pure set or of a vector space, projective space or affine space over a finite field such that the new relations are sufficiently independent of each other and over the original structure. In particular, the random graph belongs to this class, since it is a sufficiently independent expansion of an (...) infinite set, with no structure. The class also contains structures for which the pregeometry given by algebraic closure is non-trivial. (shrink)

I develop an account of our capacity to know what we consciously believe, which is based on an account of the phenomenology of conscious belief. While other recent authors have suggested that phenomenally conscious states play a role in the epistemology of self-ascriptions of belief, they have failed to give a satisfying account of how exactly the phenomenology is supposed to help with the epistemology — i.e., an account of the way “what it is like” for the subject of a (...) conscious belief makes it rational, for her, to self-ascribe that belief. I argue that an account according to which the phenomenology of belief is transparent — i.e., such that in having a conscious belief one is aware of the world as being a certain way, rather than of anything distinctively mental — is adequate to this task. Regress arguments have convinced many that reasoning cannot require beliefs about what follows from what. In this paper I argue that this is a mistake. Regress arguments rest on dubious (although deeply entrenched) assumptions about the nature of reasoning — most prominently, the assumption that believing p by reasoning is simply a matter of having a belief in p with the right causal ancestry. I propose an alternative account, according to which beliefs about what follows from what play a constitutive (...) role in reasoning. (shrink)

This book presents my concept of poetic thinking in the context of debates around the anthropological question, that is 'what is being human?', building on 'thinking language' and dialogical thinking, developing a poetological anthropology. It evokes political and social issues to demonstrate why poetics is of general relevance for our times. The essay relates these questions to insights of quantum physics and neurosciences and discusses aspects of contemporary technology, media and medicine, employing notions from contemporary thinkers, such as atmospheres, immanent (...) transcendence, silence and presence. Poetic thinking considers the world in its togetherness, offering an alternative to the opposition of subject and object. It demonstrates the transformative power in the interaction of the form of language and the form of life. Poetic thinking takes place when a subject constitutes itself in creative and dialogical language, transforming its ways of feeling and thinking, in short, its way of perceiving the world. (shrink)

Empirical research into political sentiments gives force to the proposition that, in the context of the 2013–14 Euromaidan and subsequent war, Ukrainian national identity, for most of its history predominantly ethno-cultural, has undergone changes justifying its qualification as ‘civic’. In this article I discuss the ethno-cultural orientation, conventional during the 19th and 20th centuries, of Ukrainian literary history, a scholarly genre that has a tradition of promoting the cause of Ukrainian nation-building; I identify contemporary examples of discourses in the literary (...) sphere – literary works themselves, literary anthologies and the public statements and debates of writers – that embody or applaud civic identities akin to those in evidence on the Euromaidan; and I reflect upon the values, inclusive and multicultural, that a Ukrainian national literary history rhetorically in harmony with post-Euromaidan sentiment would evince. Derrida has been interpreted as a nihilist and relativist. This study demonstrates that he has an ethics and a concern for religion that goes beyond the structures of the philosophical tradition.

Which epistemic value is the standard according to which we ought to compare, assess and design institutional arrangements in terms of their epistemic properties? Two main options are agent development and attainment of truth. The options are presented through two authoritative contemporary accounts-agent development by Robert Talisse’s understanding in Democracy and Moral Conflict and attainment of truth by David Estlund’s treatment, most prominently in Democratic Authority: A Philosophical Framework. Both options are shown to be unsatisfactory because they are subject to (...) problematic risk of suboptimal epistemic state lock-in. The ability of the social epistemic system to revise suboptimal epistemic states is argued to be the best option for a comparative standard in institutional epistemology. (shrink)

The article explores the specific conception of art developed by Danko Grlić, a prominent member of the Yugoslav Praxis School. Grlić conceptualised art beyond both aesthetic norms and technological determinism. Within the context of praxis philosophy, a distinct theory of the subject and a Marxist humanist approach, he reconceptualised art as a distinct type of praxis, a revolutionary and creative practice of changing existing living conditions. The article explains how his unique understanding of art leads Grlić to analyse, criticise and (...) refute various Marxist approaches to art: art as an ideology, art as a reflection of the objective world, art as sociological analysis. Moreover, while sharing many ideas and conceptions with Walter Benjamin’s materialist conception of art, Grlić reached the point where he became critical due to Benjamin’s belief in technology concerning processes of emancipation, which Grlić viewed with scepticism.
